It was only all these years later, after James researched his name on Google that he was presented with links to several porn websites where a video had been distributed without his knowledge. Someone who didn’t particularly like him, found the porn video on the internet, downloaded it and uploaded it again, to various porn websites, together with James’ full name.

After many sleepless nights and trying to contact the website operators himself asking them to remove the video from the porn sites, where James could find the videos, he had no luck and was met with automated and blank responses. He knew that there was a legal route to achieve his goals and we were able to offer him this relief that indeed we could help him. James could not understand how this video had been so widely distributed without his consent and was distraught to find that the video had even been cut up into smaller videos which meant people could find individual clips. The methods to have these videos taken down depended on the context behind how the videos were made in the first place and we told James that he needed to own the intellectual property rights to the video and if he did not we would need to get those for him.
He told us that indeed he had filmed this video on his own accord and he therefore owned the rights and the copyright. We were therefore able to advise James that we would serve a Digital Millennium Copyright Act notice (DMCA) on the website operators where James was able to identify the existence of the videos. The purpose of this notice is to inform the website operator that the material they are showing on their website infringes copyright.
Another route for James, if he was worried that the website operators may not all comply with our DMCA notices, was that we could submit an application under a Right to Be Forgotten to Google and to each of the website operators. The outcome of a multiple Right to Be Forgotten request would almost erase James' identity from the internet in relation to all the videos on the porn sites.
